Terms of Service

You may read this site and send us an inquiry. Please give us accurate details, because we use them to work out a price, and a quote built on the wrong numbers helps neither of us.

Do not attempt to break, overload, scrape or gain unauthorized access to the site, and do not use the inquiry form to send anything unlawful. We rate limit submissions and run a bot check for this reason.

Sending an inquiry does not create a contract or oblige either of us to anything. It starts a conversation.

ToteOS is hosted software for tote and moving box rental businesses. It provides a public booking site on your own domain, an availability engine, online checkout, an operator admin, and the billing that goes with extensions, damage and loss.

We set it up with you rather than handing you a login. That includes your branding, packages, prices, delivery area and domain. What is included in your setup is whatever we agreed in writing when you signed up.

We add and change features. We will not remove something you rely on without telling you first.

You connect your own Stripe account. Money from your rentals is paid by your customers into your account, on Stripe's normal payout schedule, and we never hold or route your revenue. We do not take a percentage of a booking.

Stripe's own terms apply to that account and to the payments made through it. Their fees are between you and Stripe.

You are the merchant for your own rentals. You set your prices, you supply the equipment, you are responsible for your own terms with your customers, and for any tax you owe. Nothing here makes us a party to a rental you agree with somebody.

Your customer records, bookings and settings belong to you. We hold and process them so the software can run, and for no other purpose. We do not sell them, and we do not use one operator's data to benefit another.

Your domain is registered to you and stays yours. If you leave, you point it wherever you like.

Ask us for an export at any time and we will give you one in a machine readable format. On termination you get a final export, and after a reasonable window to collect it we delete your data other than what we have to keep for tax and accounting records.

Pricing depends on the size of your operation and is agreed in writing before anything is charged. There is no public rate card and no charge is made without you having seen the number first.

If we change your fees, we will tell you in advance and you can leave rather than accept the change.

We aim to keep the service running continuously and to fix faults quickly, and we will give notice of planned work that takes it offline where we reasonably can.

Being straight about this: ToteOS is early, and there is no uptime guarantee or service credit scheme at this stage. If you need a contractual availability commitment, ask us and we will write one rather than pretend this page is it.

Use the service lawfully. Do not use it to defraud anyone, to send unsolicited bulk email, to store data you have no right to hold, or to take payments for anything you are not entitled to sell.

Do not resell or sublicense the software as your own product, and do not attempt to copy, decompile or work around its technical limits.

We may suspend an account that is being used this way, or that puts other operators or their customers at risk. Where the situation allows it we will tell you first and give you a chance to fix it.

You can stop using the service at any time. Tell us, take your export, and point your domain elsewhere.

We can end the arrangement with reasonable notice, and immediately in the case of unlawful use or non payment. If we end it for our own convenience, we will refund any fees you have paid for time you will not get.

We provide the service with reasonable skill and care. We do not promise it will be uninterrupted or error free, and we are not responsible for failures caused by things outside our control, including your Stripe account, your domain registrar, or your own use of the admin.

We are not liable for indirect or consequential loss, including lost profits or lost business. Where we are liable, our total liability is limited to the fees you paid us in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

We may update this page. If a change materially affects a customer, we will tell them directly rather than relying on them noticing the date at the top.

These terms are governed by the laws of the Commonwealth of Kentucky, and the courts of Fayette County, Kentucky have jurisdiction over any dispute.
